Detainee beats off deportation

Issue No. 2051

An Algerian asylum seeker who was cleared of involvement in the so called “ricin terror plot” has won a court battle against government attempts to deport him.

Mouloud Sihali said he faced the risk of torture if he was sent back to Algeria. A judge at the Special Immigration Appeals Commission (Siac) ruled that Mouloud was not a “threat to national security” and should not be deported.

The Siac tribunal ruled in favour of deporting three other Algerians, known only as W, U and Z. Detainee W is another acquitted former defendant in the “ricin plot” trial.

Detainees U and Z have been held in custody without charge or trial since 2001. Neither man has even been interviewed by police about the “threat” they are alleged to pose.
