An Employment Appeal Tribunal judged in favour of victimised union activist Tony Staunton after he was barred from standing in union elections. The court rejected an appeal lodged by the Unison union to overturn a ruling in favour of Tony by the Certification Officer.
The ruling found that Unison had broken the law when preventing him from standing for the executive.
The Certification Officer found last May that Tony was “unreasonably excluded” from being a candidate in the 2007 national executive elections.
The judge in the appeal upheld the initial judgment against Unison.
In a second case Yunus Bakhsh, who was sacked by his health authority and victimised by Unison, the Employment Appeal Tribunal overruled a Certification Officer ruling saying that his case against the union was not made in the required time.
Further, the judge also ruled that the phrase in the rule book “face charges” could refer to future charges so Yunus could be suspended from office under Unison rules. However, the judge added that this interpretation made the ruling in favour of Tony Staunton even stronger.
