Ruling backs Tupe rights

A ruling by the Employment Appeal Tribunal has opened the way for workers to bring unfair dismissal cases automatically when their work location changes as a result of a change in employer.

The case involved five London bus drivers on the 414 bus route. This had been operated by CentreWest from the Westbourne Park bus depot. But the route was transferred to Abellio and its Battersea depot.

Tupe regulations allow workers to bring claims for “automatically unfair dismissal” if a change of employer results in “significant change to their material detriment” to their working conditions.

The five drivers won a tribunal in December 2010, but Abellio appealed. The company’s appeal was rejected earlier this year.
