New challenge over Mark Duggan inquest

Mark Duggan’s mother Pamela has launched a legal challenge against the judge who presided over the inquest into Mark’s death.

Police shot Mark dead in August 2011 in north London.

Pamela is seeking leave for a judicial review against Judge Keith Cutler.

In January the inquest jury concluded Mark had been “lawfully killed”—yet a majority agreed that he wasn’t holding a gun when he was shot.

Lawyers for the Duggan family argue that Cutler should have directed the jury that they could not return a conclusion of lawful killing if they decided Mark wasn’t holding a gun.

They are asking for a court order to kick out the lawful killing conclusion and replace it with an open one. Alternatively they are requesting an order invalidating the inquest's conclusions and ordering a fresh inquest.
